Acceptable Use Policy

Hoshin Space is built for legitimate field service businesses — cleaners, landscapers, handymen, and similar trades. This Policy defines who may use the Platform and what conduct is permitted. Violation of this Policy may result in immediate suspension or permanent termination without refund.

1. Purpose and Scope

This Acceptable Use Policy ("AUP") governs the conduct of all Service Providers (businesses) and End Users (their clients) who access or use the Hoshin Space platform ("Platform"), operated by Saldana Tech LLC d/b/a Hoshin Space ("Hoshin Space," "we," or "us").

This AUP is incorporated by reference into the Hoshin Space Platform Terms of Service. Capitalized terms not defined here have the meanings given in the Platform Terms of Service.

This Policy applies globally to all users. Additional restrictions may apply based on local laws. It is your responsibility to ensure your use of the Platform complies with all applicable laws in your jurisdiction.

2. Who May Use the Platform

2.1 Eligible Users

The Platform is available to:

Legally registered businesses and sole proprietors operating in the United States.
Individuals who are at least 18 years of age and have legal capacity to enter contracts.
Service-based businesses in the field services sector, including but not limited to: residential and commercial cleaning, lawn care and landscaping, handyman and home repair, pest control, pool and spa maintenance, pressure washing, painting, HVAC maintenance, and similar trades.

Hoshin Space reserves the right to verify business legitimacy, require proof of licensure where applicable, and decline or terminate service to any applicant or customer at its sole discretion.

2.2 Account Accuracy

You must register with accurate, complete, and current information. Accounts registered with false business names, fictitious addresses, or fraudulent payment information will be terminated immediately. Impersonating another business, person, or entity is strictly prohibited.

3. Prohibited Business Types

The following categories of businesses are PROHIBITED from using the Platform. This list reflects Stripe's Restricted Business policy, applicable U.S. law, and Hoshin Space's own risk standards. It is not exhaustive — Hoshin Space may deny service to any business type at its discretion.

3.1 Weapons and Regulated Items

Firearms, Ammunition, and Accessories — Sales, rentals, repairs, or services involving firearms, handguns, rifles, shotguns, automatic weapons, or their components and accessories. This includes gunsmiths operating as a primary business, firearms cleaning services marketed to the general public, and mobile firearms training where payment is processed per session.
Explosives and Pyrotechnics — Manufacturing, storage, distribution, or services involving explosives, blasting agents, fireworks (commercial or consumer), or pyrotechnic devices requiring federal or state licensing.
Knives and Bladed Weapons — Retail or service businesses whose primary revenue derives from switchblades, ballistic knives, throwing stars, and similar items prohibited under applicable law.

3.2 Adult and Age-Restricted Content

Adult Entertainment — Any business whose primary or significant revenue derives from pornography, sexually explicit material, adult webcam services, escort services, or services marketed on adult content platforms.
Strip Clubs and Adult Venues — Booking, scheduling, or payment processing for adult entertainment venues, gentlemen's clubs, or similar establishments.
Age-Restricted Products — Businesses whose primary function is the sale, delivery, or service of tobacco, vaping products, electronic cigarettes, or alcohol directly to consumers, unless the Platform is used solely for ancillary scheduling (not payment processing) and the business holds all required licenses.

3.3 Gambling and Games of Chance

Online and Offline Gambling — Casinos (online or physical), sports betting, poker rooms, lottery ticket sales, raffles involving cash prizes, sweepstakes that constitute gambling under applicable law, and fantasy sports platforms where real money is at stake.
Skill-Based Gaming for Money — Any platform or service business where customers pay to participate in games, competitions, or contests with cash prizes, regardless of whether the outcome is characterized as skill-based or chance-based.

3.4 Financial Services and Cryptocurrency

Cryptocurrency and Digital Assets — Cryptocurrency exchanges, crypto mining operations, NFT marketplaces, digital token issuance, crypto ATM operations, and businesses providing crypto investment advice or portfolio management.
Money Services and Transmission — Money transmitters, check cashing businesses, currency exchanges, payday lenders, pawn shops, hawala or informal value transfer services, and any business requiring a money services business (MSB) license unless such license is independently verified by Hoshin Space.
Investment and Securities Services — Businesses providing investment advice, securities brokerage, commodities trading, or fund management without the required SEC, FINRA, or state registration.
Debt Collection — Third-party debt collection agencies, debt settlement companies, credit repair services, and businesses that purchase or collect defaulted debt.

3.5 Multi-Level Marketing and Pyramid Schemes

MLM and Network Marketing — Any business where the primary revenue model requires recruiting participants who pay to join, regardless of the underlying product. This includes all multi-level marketing structures where distributor commissions depend on recruitment rather than genuine retail sales.
Pyramid and Ponzi Schemes — Any structure in which returns to existing participants are funded primarily by payments from new participants, including gifting circles, blessing looms, and similar arrangements.
Get-Rich-Quick Schemes — Businesses marketing guaranteed investment returns, passive income programs, or work-from-home opportunities where the income model is unverifiable or deceptive.

3.6 Controlled Substances and Drug-Related Businesses

Illegal Drugs and Controlled Substances — Sale, delivery, distribution, or services related to illegal drugs or controlled substances under federal law, including marijuana businesses in any form (regardless of state legality, as Stripe's federal compliance requirements apply).
Prescription Drug Services — Online pharmacies, telemedicine platforms offering prescription fulfillment, or businesses facilitating the purchase or importation of prescription medications without a valid prescription.
Drug Paraphernalia — Businesses whose primary revenue derives from the sale or rental of drug paraphernalia, regardless of how it is characterized or labeled.

3.7 Regulated Professional Services

Legal Services Accepting Payment in Advance — Law firms or legal services businesses that use the Platform to collect advance fee retainers or trust account deposits (which require compliance with state bar trust account rules incompatible with the Platform's payment model).
Unlicensed Medical, Dental, or Clinical Services — Any business performing medical, dental, therapeutic, or clinical procedures without proper state licensure for each practitioner. This includes unlicensed cosmetic procedures (e.g., botox, filler injections by unlicensed individuals).
Bail Bond Services — Businesses providing bail bond services or related surety products requiring specialized licensure.

3.8 High-Risk and Disreputable Practices

Telemarketing and Robocall Operations — Outbound telemarketing businesses, robocall services, or lead generation businesses that use unsolicited calls or messages.
Counterfeit or Infringing Goods — Businesses that knowingly sell, service, or distribute counterfeit, stolen, or intellectual property-infringing goods.
Timeshares and High-Pressure Sales — Timeshare sales, vacation club memberships, or any business model characterized by high-pressure sales tactics or negative option billing.
Psychic and Fortune-Telling Services — Psychic readings, astrology consultations, fortune telling, and similar services where the primary value proposition is unverifiable supernatural claims.
Human Trafficking or Exploitation — Any business involved in human trafficking, forced labor, or the exploitation of individuals. Hoshin Space will report known violations to law enforcement.

3.9 Political, Religious, and Advocacy Organizations

Political Campaigns and PACs — Political campaign committees, PACs, super PACs, 527 organizations, or any business using the Platform to collect political contributions or donations.
Religious Donation Collection — Religious organizations using the Platform primarily for the collection of tithes, offerings, or religious contributions rather than for legitimate field services.

4. Prohibited Conduct

Regardless of business type, all users are prohibited from the following conduct on the Platform:

4.1 Fraudulent and Deceptive Activity

Processing payments for services not rendered or not intended to be rendered.
Submitting false or fabricated job completion records to trigger unauthorized charges.
Enrolling fictitious End Clients or fabricated payment methods to test or exploit the payment system.
Misrepresenting the nature, price, or scope of services to End Clients.
Initiating or encouraging fraudulent chargebacks on legitimate transactions.

4.2 Data Misuse

Using End Client data collected through the Platform for any purpose other than delivering services to that End Client.
Selling, renting, or licensing End Client contact information or payment data to any third party.
Uploading data belonging to individuals without their knowledge or consent.
Attempting to extract, scrape, or export Platform data in bulk through unauthorized means.
Using the Platform to build a competing product or to reverse-engineer Platform functionality.

4.3 System and Network Abuse

Attempting to gain unauthorized access to Platform systems, databases, or other users' accounts.
Introducing malware, ransomware, viruses, or other malicious code into the Platform.
Conducting denial-of-service attacks or deliberate actions that degrade Platform performance.
Using automated scripts, bots, or crawlers to access the Platform without written authorization.
Circumventing rate limits, security controls, or authentication measures.

4.4 Harmful Communications

Using Platform-generated communications (receipts, confirmations) to send spam, phishing messages, or unsolicited marketing.
Sending threatening, harassing, or abusive communications to End Clients through the Platform.
Impersonating Hoshin Space in communications with End Clients or third parties.

4.5 Legal Violations

Using the Platform in violation of any applicable local, state, or federal law, including consumer protection, anti-spam (CAN-SPAM, TCPA), data privacy, and payment regulations.
Processing payments for goods or services that are illegal in the jurisdiction of the Service Provider or End Client.
Violating any applicable payment card network rules (Visa, Mastercard, Amex, Discover).

5. Stripe Restricted Businesses

Because payment processing is provided through Stripe, all Hoshin Space users are also bound by Stripe's Restricted Business policy. Stripe's list of prohibited and restricted categories includes, but is not limited to, the business types enumerated in Section 3 of this AUP.

In the event of a conflict between this AUP and Stripe's Restricted Business policy, the more restrictive standard applies. Hoshin Space is not obligated to give advance notice before suspending an account that violates Stripe's policies, as such violations may cause Stripe to suspend Hoshin Space's own payment processing capabilities.

6. Enforcement

6.1 Monitoring

Hoshin Space reserves the right, but does not assume the obligation, to monitor Platform activity to detect violations of this AUP. We may review account activity, transaction patterns, and business descriptions as part of ongoing compliance efforts.

6.2 Consequences of Violation

Violations of this AUP may result in one or more of the following actions at Hoshin Space's sole discretion:

Written warning requiring remediation within a specified timeframe.
Temporary suspension of Platform access pending investigation.
Permanent termination of the account without refund of prepaid subscription fees.
Withholding of pending payouts pending resolution of a dispute or legal matter.
Referral to law enforcement or regulatory authorities where required or appropriate.
Civil legal action to recover damages caused by the violation.

6.3 No Obligation to Investigate

Hoshin Space is not obligated to investigate potential violations before taking enforcement action. Where a violation is apparent or poses risk to other users, the Platform, or Hoshin Space, we may act immediately without prior notice.

6.4 Appeals

If you believe your account was suspended or terminated in error, contact support@hoshinspace.com within 14 days of receiving notice. Include your account email, a description of your business, and the basis for your appeal. We will review and respond within 10 business days. Submission of an appeal does not guarantee reinstatement.

7. Reporting Violations

If you become aware of a user violating this AUP — including suspected fraud, data misuse, or illegal activity — please report it to:

Include: description of the suspected violation, relevant account or transaction details (if known), and any supporting documentation.

All reports are treated confidentially. Hoshin Space will investigate and take appropriate action. We do not guarantee a response to every report but take all submissions seriously.

8. Updates to This Policy

Hoshin Space may update this AUP at any time. For material changes, we will provide at least 14 days' written notice to Service Providers via email or in-Platform notification. Changes to address newly identified risks or changes in Stripe's restricted business policies may be effective immediately.

Continued use of the Platform after the effective date of any update constitutes acceptance of the revised AUP.
